>> with the time change the sun starting to creep up earlier giving us a spectacular look over san francisco with the transam building there. at the pinnacle of the shot. happy monday. it's november 4th. this is "today in the bay." it's 6:00. good monday morning. thanks for joining us as always i'm jon kelley. >> i'm laura garcia-cannon. new this morning investigators trying to figure out what caused a driver to hit a wheelchair with a man who was crossing a busy street. it happened near market street and octavia in the hays valley neighborhood. christie smith live in san francisco at the intersection, christie, there's been a lot of problems there before. >> reporter: yes, that's right. even after this intersection was partly shut down because of this fatal accident overnight i've seen a number of people running into the crosswalk against the

light. the city has put up warning signs letting drivers know they cannot make the right turn here. it's illegal. but a man in a wheelchair was hit by a car overnight. his wheelchair, you can pan over, it landed here. you can see some of the orange markings. he was trying to cross octavia on market street. details of the crash, that's part of the investigation. what we can tell you the driver did stop at the scene, cooperated with police. we tried to speak with him. he stood out because he was dressed in security guard type uniform. the victim a man in his 20s was taken to sf general hospital where he died. an officer described the disturbing scene. >> when officers arrived they found a wheelchair several feet up the ony& ramp of the freeway. and the victim of the wheelchair was outside his wheelchair.

>> reporter: three days ago the city turned on a photo enforcement system at this intersection which has the most injury collisions in san francisco in 2011. cars trying to purrly on the southbound 101 making that illegal right turn. drivers caught will get a warning at least for now. then starting on best 1 they get a fine of 238 and a point on their driving record. christie smith, "today in the bay." >> the parents of the 13-year-old shot by a deputy holding a press conference this afternoon to talk about filing a civil rights lawsuit against the deputy and the county, claiming the shooting was unconstitutional. the lawsuit alleges the deputy shot young lopez without reasonable cause and that violated the boy's fourth amendment. almost two weeks ago that deputy mistake the boy's replica for a real at 47 and shot him seven times. the deputy claims the boy

started to point that at him and the deputy feared for his life. we're learning more about the 23-year-old gunman who opened fire in los angeles international airport, killing one tsa officer and wounding three others. we're getting a look at his home in southern california. marla tellez is in the newsroom with an update on that investigation. that could take some time to finish off. good morning. >> reason being for that is because 23-year-old paul ciancia is still in critical condition this morning. officials say he was shot in the face a few times so he is unable to speak to authorities. so far officials have the handwritten manifesto found in his duffle bag. that's shedding a little like as he writes about his malice toward tsa searches. investigators are talking to his

roommate and neighbors in the suburb of sun valley is this is about 35 miles north of l.a.x., this is new video which shows his apartment, 111, neighbors say they had only see him a few times since he moved here. one woman was startled. >> they were here all day and they couldn't come inside or get out. the fbi agent, he spoke with me. i was very scared. i was that day in my house. >> we want to take you live to l.a. and give you a look at the airport. the pillars are lit up in blue. this is in honor of gerardo hernandez the officer allegedly shot and killed friday morning. in addition to hernandez two other agents were shot. they have been released from the

hospital. this guy is a local teacher. he was shot but is still hospitalized you can see but is recovering just fine. he has to undergo another surgery, then should be able to be released. hernandez the agent who was killed had only worked for the tsa for three years. he would have turned 40 years old this week. i'll tell you the weapons that ciancia owned and whether they were legally purchased. >> a tragedy for that family. the convicted felon charged with killing will be in court. randy pled guilty. he admits to being at the hotel where investigators believe coke was killed. a monitor indicated he was at the hotel for 38 minutes on the night cokes disappeared.

he faces life in prison if convicted. >> this morning a suspect in custody in connection with a deadly shooting near san jose. that happening early yesterday morning. the victim a man in his 30s was shot at least once. family members drove him to the hospital where he was pronounced dead. in less than an hour police say the suspect who apparently knew the victim was in custody. the shooting marked the 39th homicide this year. five more than the city had at this same time last year. >> at this same time last week the sunday wasn't up but now. look at that. what a time change will do. gives you an hour sleep. >> extra motivation, beautiful shot there driving type work or grab a donut. >> get your day started early. i want to check the forecast with christina. >> it's going to get prettier and prettier as the sun starts

to make its way up across the horgs. a beautiful start here, this is from san bruno. temperatures are gilly because it's so clear. throughout this afternoon we'll see a really nice rebound. 33 degrees, one away from freezing. in napa, nonetheless we're headed to mid-70s, 70 dpres bay side. then we're tracking a warm-up only to be followed by some showers. that's all coming up in the seven-day forecast. we'll time out the changing weather. let's track that changing drive. here is mike. >> we have a lot of folks giting the road earlier maybe she -- or extra will tep them get out on time. >> looking at somebody 101. there is a good amount of congestion. for the south bay you have a normal traffic flow except for 101. the northbound side very slow from capital expressway up

report this morning says the american league west champs might host their home game at at&t park. >> bob's got the details. good morning. >> good morning to you, laura and jon. this unusual arrangement would be temporary. only two years, if it were to happen it would start next season. this is all according to the "san francisco chronicle." the a's for the o.co organization. the lease is up. the team has not been able to come to agreement with the commission. they want control over concessions and like a several year lease heil the team wants two. major league baseball suggesting that the two teams share at&t park as a temporary solution. why would the giants want to

share this, as the ground points out the aids move there is almost no moving back. and a move to the south bay is looking unlikely. therefore, this would almost work the a's to move out of the bay area leaving this market to the giants. a couple complicationcomplicati. if the two share the same park they have home games on the same day. that happens nine times next season. >> boy, interesting to see if they have to do it. >> the nfl, the jets and counties. but baseball, they have 162 total games. >> a long time. coming up a group taking on

pain. >> i want to get you up on today's top stories. san francisco police investigate a crash that leaves a person in a wheelchair dead. this happened about midnight near market street and octavia. the person was pronounced dead at the hospital. the driver did stay at the scene. it's unclear if he or she will be facing charges. >> the trial of ousted president mohammed morsi was adjourned just hours after it got under way this morning. as you can see they postponed the hearing until january. >> the supreme court which asks for god's protection before every public session will be hearing arguments in a dispute over prayers at government meetings. the case being argued involves prayers at the start of town council meetings in a new york suburb. >> congress is working on a bill

which would prohibit discrimination based on sexuality or gender identification. >> protections californians enjoy. >> state law covers that here as it does in a number of states a. new federal law would make it the law of the land. apple's ceo added his voice saying in "the wall street journal" it was a matter of human rights and decently..%9 we've found that when people feel valued for who they are they have the comfort and the confidence to do the best work of their lives. currently the federal law prohibits workplace discrimination based on gender but not gender identity f. you feel you would like to be recognized as a different gender, that's who you feel like inside you're not protected under federal law. no mention in the federal law of sexuality but california has

tuesday into wednesday we get a nice warm-up. the jet stream takes a tip to the out and we could talk about showers starting thursday, better chance saturday to sun. we'll have to see what happens. it could wow me. i'll give it time. here is mike. whatever. you work it out. here we're working out a slower drive. typical from this time of day. what am i saying we had the hour time change. folks hit the road earlier. no big surprises. we'll see that a lot more light. the north bay a smooth flee typical of the south bay we see this dogged down north 101. that caused the distraction and that kicked off the flowing. a little farther south than we might expect.

the try valley, 680, all building a little bit earlier on a typical monday. we have a -- shouldn't be a big deal as you approach. slow off the yi, north and south had incidents. we have a good slowdown because of an earlier crash. there was debris that has cleared. let's focus here toward the san mateo bridge. over the bay the westbound commute, had an early hit of traffic and then it cleared up coming toward us. looks like it's cleared. the peninsula, 101 southbound toward the son it's brightly lit. watch for that and for it just past university all the way do mountain view. >> thank you. now to a preview of an

investigative unit report. too many flights, not enough pilots creating a safety problem in many flights. they point to a growing demand for pilots as a cause for many young inexperienced to be washed into the -- hundreds of lives at stake. our unit goes behind the scenes inside the cockpit and inside flight schools all over. eeshl specializing in training pilots. we talked to flight instructor who is say the current system rushes foreign pilots while sacrificing the safety of the traveling public. >> it should worry any responsible pilot that copilots are getting into cockpits and simply they are unprepared for the task that they are being paid. >> travel with our investigative team as they go inside the system of training foreign

houston texans undergoing tests after he collapsed right out on the field during last night's ball game. the 52-year-old hunched over and dropped to his knees while heading to the locker room during halftime. the reports are he was light headed and very dizzy. the team says no, he did not have a heart attack and he was conscious, good news he was conscious at the time he was taken off the field. he remains in the hospital now. this morning with his family there by his side. >> let's hope he's okay. raiders on the wrong side of a record night. philadelphia's eagles quarterback threw for seven touchdowns last night. tying an nfl record. five other quarterbacks in nfl history have thrown seven touchdown passes in a game including the broncos peyton manning earlier this year. final score, 49-20. >> that was ugly. the new world champions of baseball getting set for a clean

elections. good morning. lfrnlths. >> reporter: good morning, all of the techies may be working late at night, the government has announced they will shut down healthcare.gov twrying to figure out what's wrong with this website. they need down time when people aren't trying to get on it. it's back up as of this morning, not clear how quickly it's running. but it is becoming more than just a nuisance. even a p.r. problem for the obama administration. it is now a political problem for democrats. we're looking at a number of races tomorrow, the new jersey governor's race, the virginia governor's race, we saw president obama out campaigning for that over the weekend. the new york mayor's race and the message from republicans seems to be if you don't like the roll-out of healthcare.gov, if you don't think the health law is working consider voting for republicans because the

party wants to get rid of so it we may see impact of this last month of challenges and problems with this website in the elections as the polls open tomorrow in many states. >> interesting to see what happens. thanks so much, tracy. >> nothing short of a rough night for a student who ended up spending the night at the hospital after being trapped between the walls of his dorm and a parking garage. the 19-year-old was found last night five floors below his bedroom. he was reported missing saturday morning after a fire drill in the dorm. this one was a rough scene. firefighters took about an hour and a half to get the man out. he was alert but at this point it's unclear how he got there. and how long he was trapped. the good news, beyond getting out he is expected to make a full recovery. >> all 11 people on two planes

survived after crashing over wisconsin. this is what's left of one of the two sky diving planes that crashed on saturday. they were flying at 12,000 feet seconds away from the final jump of the day. suddenly the planes collided and one wing sheared off. the jump out of the way of the falling pieces of plane. the pilot of the second plane managed to land safely. lucky there. >> walnut creek police say a pair of burglaries were committed by the same person. the burglar breaks through a glass door at a thai restaurant. then he yanks out the register and runs off with it. the owner says $200 was inside. officers say another restaurant in the mall was also burglarized that night. police are investigating an armed robbery at the same mall. that man pulled out handgun, demanded money from the cashier. >> these days it's not that unusual for high schools to have

security cameras but it's more common at middle and elementary schools in one county. according to the marin ij the school district is installing security cameras at hamilton meadow park, san jose and the hill education center. installation will start today, costing more than $120,000. last year the district did spend $177,000 installing cameras at a couple of high schools. the district telling the journal it won't put cameras in classrooms, bathrooms or other buildings. they will be on the outside of buildings pointed at entrances and corridors. >> tomorrow is election day and there are several key measures. in san francisco t the initiative 8 washington street would transform the waterfront along the embarcadero. the initiative includes creating new housing, public parks, open

we'll talk about the shower chance. we have four days where we could see light scattered shower activity. 75 inland, 70 bay side, 68 degrees, a lot more sunlight out there, probably grab your shades before you hit the road. >> definitely. we call it the sunrise slowdown. those who don't get that have it for the last 6 months get it today. looking to the east shore freeway, this is a well lit freeway. we had an earlier build. the normal pace, university avenue, a better view as we talked about. west 80 through the area as well as south 680, very slow coming down through walnut creek. back to that we'll see the only major problems. not major, just major for slowing traffic. 24 not a problem and easy drive for 580 and north 880. the southbound side of 880 slow from san leandro through

hayward. earlier crash and debris have cleared but this is also causing a backup. congestion leads to slower speeds. toward the crossings, moving through the peninsula, no delays for 101 or 280, in the south bay, in the northbound routes the ones that are kicking in. here in the south bay we'll give you a live look at the volume, north 101 at 680 starting to bog down as this sort of hits that tipping point here. >> 6:37. still ahead disrupted before it could begin. the courtroom outburst just a few hours ago causing a major delay in the trial of egypt's ousted leader. >> a beautiful look, the kind of thing that makes you want to get out of wed and go see. we've got you covered. the bay bridge there looking

hardliners who oppose president hassan rowhani's initiative to ease tensions with the u.s. smaller scale protests occur every year outside the compound to mark the anniversary of the 1979 embassy takeover following the islamic revolution. the two countries have not re-established diplomatic relations since. >> a trial of mohammed morsi has been adjourned now hours after it got under way. the judge postponed the hearing until january 8. this coming after a two-hour delay caused by morsi's refusal to change into a prison uniform. morsi stands charged with insighting the murder of protesters, tried along side 14 senior brotherhood officials and we're told the defendants extremely loud chants disrupting to the proceedings. the trial marks morsi's first public appearance since his

we're learning new details about the 23-year-old gunman who opened fire inside los angeles international airport three days

ago, killing one tsa officer and wounding three others. we're getting a look at his home in southern california. marla tellez is live in the newsroom with an update on the investigation including what officials say he singled out and who in his handwritten manifesto. >> paul ciancia named janet napolitano in his handwritten manifesto. she was our department of homeland security secretary until a few months ago. she is the president of the uc system. this is video of her in the bay area last week visiting a high school in oakland. ciancia writes he is upset with her. he doesn't say why other than he feels his constitutional rights were violated by tsa searches. he laid out what he planned to do once inside l.a.x. >> we found a statement where he made a conscious decision to

kill multiple tsa employees, he addressed them at one point in the letter and stated he wanted to, quote, instill fear into their traitorous minds. >> on friday ciancia was armed with an assault rifle. it was found in terminal 3. they found two handguns that he purchased in los angeles. these two weapons were not at the crime scene. they didn't say if they found them at his apartment in sun valley, this is what you're looking at now. this is where he lived with at least one roommate about 35 miles north of l.a.x., but officials say all of his weaponry was purchased legally from a lngsed dealer. for the victims in this we want to mention 39-year-old hernandez a tsa agent killed, he would have turned 40 this week, a father of two. two other agents were shot.

they survived. they are out of the hospital. a third man was shot, a local teacher, he is recovering in the hospital. he is expected to be released in the near future. federal officials say ciancia is still lifted in critical condition, they say they doesn't have a criminal history but now with the charges he faces they qualify him for the death penalty. i want to mention i flew to l.a.x. over the weekend and spoke to some agents about this incident. i asked what's the mood among their colleagues, i asked one man, he said he gave me a one-word answer. he said "somber." >> i bet. they lost a member of their team. so sad. let's turn to better news. that includes the weather. with the time change over the weekend that means our sunrise coming earlier. such a treat over the bay area. >> extra sleep, extra spectacular shots.

>> extra sunlight for the morning drivers makes it more safe especially for the kids that have to wait for the bus. 6:48 now. a live look, let's show you san bruno. we showed you san jose. a beautiful start. as we head to the evening with the time change the sun will set at 5:15 so it's going to get dark earlier. 47 degrees in san francisco. temperatures are chilly out there. especially up in the north bay this morning so make sure you're ready for a cold start to the day. you probably want to layer up as temperatures will climb nicely. the one thing we're going to have to deal with later on today some fierce wind especially at the coast and through the higher elevations. stop the clock on futurecast, you'll notice where you get the oranges, close to hot pink, that's where we expect really strong wind. 35 to 40-mile-per-hour gusts possible as we head throughout the afternoon. you keep that in mind. a really good looking day temperaturewise. 73 in livermore. 70 degrees in san jose today.

i want to spend time since we're reaching a new week, this is your new seven-day forecast. there are changes headed our way. we're going to climb by a couple degrees tomorrow even more so for wednesday. and then temperatures will drop off on thursday, the clouds will increase. as the jet stream starts to dip to the south. we're looking at our first chance for showers late thursday into friday. and then we ramp that chance up saturday into sunday. right now it's looking most promising up in the north bay. that could change, the system is a few days out so we'll watch it closely. could get interesting as we head through the end of the week. that drive is getting more interesting. you can see the road this morning with that sunlight. >> with the sunlight. watching you'll need the sunglasses, slowdown for the peninsula. we'll talk about that in a second. looking at a slower drive. the east shore freeway had slowing but then sorted out down to the bay bridge toll plaza. we have metering lights on. south 680.

market street and octavia in the hays valley neighborhood. christie smith joins us live at the scene. the intersection, there has been a lot of controversy about this very intersection. >> reporter: good morning to you. there are a number of accidents before but i have to say even after this latest fatal accident overnight we're still seeing people running out into the crosswalk against the light. right now a crew is drilling more sensors for the cameras installed here because of the accident. this intersection has been on the city's radar for a while. a man was killed trying to cross octavia at market. hit and thrown from his wheelchair on the ramp to southbound 101. happened around midnight. details of the accident are under investigation. like whether speed was a factor or not. but the driver did stop and was cooperating with police. he stood out because he was dressed in a security guard's

uniform. there was at least one witness to the accident. we spoke with one investigator who skr described how they tried to save the man. >> transported the victim to the hospital where he was pronounced dead a short time later. >> reporter: there are new security cameras here that were turned on on friday, they are still installing the sensors. those were designed to try and catch those people making that illegal turn on southbound 101. i asked one of the workers if they were operating. he said yes, the cameras are operating. as far as the injury collisions, there was a study that said that the most in san francisco happened at this intersection in 2011. that orange spot that steve showing you, that's where the man's wheelchair was thrown to. for now if people are caught making that illegal right turn they get a warning.

that changes on december 1, they will get a fine of $238. christie smith, "today in the bay." >> thank you. 6:53 now. the parents of the 13-year-ob%q boy shot by sonoma county deputy talking about filing a civil rights lawsuit claiming the shooting was unconstitutional. the shoot alleges that the deputy shot lopez without reasonable cause and that violated the boy's fourth amendment. two weeks ago the deputy mistook the boy's rifle for a real ak-47 and proceeded to shoot him seven times. the deputy claims the boy started to point it at him and the deputy feared for his life. >> the convicted felon charged with killing federal investigator sandra coke will be in court. he pleaded not guilty to her murder last month. while alana says he is innocent, he admits to being at the hotel

where investigators believe coke was killed back in august. police say alana's gps monitor indicated he was at the motel for 38 minutes on the night that coke disappeared. along that has 17 prior felony convictions and faces drive in prison if convicted of coke's murder. >> a suspect in custody in current weather conditions a deadly shoeing. that happened early yesterday morning on morrison avenue. police say the victim, a man in his 30s, was shot at least once. family members drove him to the hospital where he was pronounced dead. in less than an hour the suspect who knew the victim was in custody. it marks the 39th homicide this year alone. five more than this time last year. >> so bay area's two big league teams could be sharing a stadium.

instead of the a's playing at o.co, the american league west champs might host their home game at at&t park. >> that would be unique twist. bob redell is live in san francisco and has the details. >> reporter: good morning. it would be an unusual arrangement if it were to happen, the a's playing here at at&t park, sharing with the giants temporary, only for a couple of years for two years. and it would start next season. in 2014. this is according to the "san francisco chronicle." the lease is up and the team has not been able to come to agreement with the oakland alameda county coliseum commission. the commission wants control over the concessions that the team now has and would like a several year lease while the team wants two. they want the lease because they anticipating moving.

major league baseball suggesting in the meantime the two teams share at&t park as a temporary solution. why would the counties want to be on this? the chronicle points out once the a's were to move to sf almost no moving back unless a new stadium would be built which seems unlikely a. move to the south bay is looking unlikely. because of territorial issues with the giants. this would almost force the team to eventually move out of the bay area, leaving the giants with this market all for themselves. one complication, they both teams do have nine home games on the same day next season which brings back, how would these teams share the park on those days. >> early day game. >> i'm thinking a doubleheader. you have to get one of those caps. >> marketing. all over that one.
